This Agreement (hereinafter referred to as the "Agreement") is entered into between the user (hereinafter referred to as the "User") and the administration (hereinafter referred to as the "Administration") of the website www.oinix.com (hereinafter referred to as "OINIX").

§ TERMS & CONDITIONS

OINIX offers, embodies, and showcases the concept of a mosaic/compilation of an associative image/logo (hereinafter "Mosaic") representing a brand, club, popular personality, etc. (hereinafter "Object") from photographs of its fans (hereinafter "Subject"). Object and Subject, under this Agreement, are collectively referred to as Users. Public mosaics, constituting compilations of associative images/logos, can be accessed, viewed, shared, or purchased by anyone. OINIX shall not be held liable for any damages incurred by the user resulting from nonobservance of this agreement.

§ GENERAL PROVISIONS

The User must thoroughly acquaint themselves with this Agreement before utilizing the OINIX website or service. Usage of the website implies full and unconditional acceptance of the Agreement. Users under the age of 13 may only use OINIX with parental permission. Use of the OINIX website/service is voluntary, and the Administration reserves the right to amend and/or supplement the Agreement without notice. It is the User's responsibility to check for any changes.

§ USER'S OBLIGATIONS

The User shall provide accurate information about themselves and commit to updating this information promptly.

§ PROHIBITED ACTIONS

The User agrees not to engage in the following actions:
Sending messages to OINIX users without their consent;
Uploading and using viruses or other malicious codes and programs;
Attempting to gain access to another user's data;
Taking actions that may disrupt, overload, or degrade the normal operation of OINIX, or using automated means that cause harmful effects on the system;
Creating an account on behalf of another person without their permission;
Creating more than one personal account;
Creating another account without the permission of the Administration if the previous account was blocked;
Using automated scripts to collect information on the site and/or interact with the site and its services;
Reproducing, copying, or duplicating the service or any of its parts;
Collecting or storing personal data of other users;
Using OINIX to attract traffic to other sites;
Representing OINIX without prior permission;
Transmitting someone's identification credentials, address lists, email addresses, phone numbers, or any other contact information without the written permission of the owners.

§ ADMINISTRATION'S AUTHORITY

The Administration is authorized to:
Block or delete a profile, remove any information or materials posted on OINIX if, in the opinion of the Administration, they violate this Agreement;
Request additional information and documents to confirm the data provided during registration;
Send information to the user about the development of OINIX and its services, as well as advertise their own activities and services.

§ DISCLAIMER AND TERMS OF USE

The Administration is committed to the confidentiality of user information. While every effort is made to ensure OINIX's safety, the Administration cannot guarantee this. The Administration is not responsible for user actions, materials, or information posted on OINIX. The Administration takes measures to protect user personal data but is not liable for temporary failures, interruptions in operation, loss of information, or user actions. Users utilize OINIX at their own risk and are responsible for any damage to their computer, data loss, and other consequences. Users are solely responsible for posted content and guarantee compensation for any damages.

§ REVOCATION OF YOUR CONSENT TO DATA PROCESSING

Users can withdraw their consent to data processing at any time. An informal notification by email is sufficient for the revocation. The legality of data processing carried out before the revocation remains unaffected.

§ RIGHT TO INFORMATION, CORRECTION, BLOCKING, DELETION

The user has the right to free information about stored personal data, its origin, recipient, and purpose of data processing. Users can request correction, blocking, or deletion of data at any time within the scope of applicable legal provisions.

§ CONTACT FORMS

Data transmitted via the contact form will be stored to process requests. This data will not be passed on without user consent. Users can withdraw their consent at any time via email. Data transmitted via the contact form remains until deletion is requested or there is no longer a need for data storage.

§ TERMINATION OF THE AGREEMENT

By submitting an online application, the Object, as a legal entity, explicitly acknowledges and agrees that the Mosaic concept is exclusively the know-how and original idea of OINIX. Termination of the agreement with OINIX is possible at any time through written notice. However, termination is contingent upon the condition that the Object will refrain from using the Mosaic concept in the future, either independently or with the assistance of another supplier/provider offering a similar service. The administrator of the profile of a legal entity/Object must be an official representative authorized by the legal entity.

§ CHILDREN

OINIX does not design any part of its web pages to attract anyone under age 13. OINIX will not knowingly accept personal information or photos from children under age 13. If a user is under the age of 13, parental consent is required.

OINIX reserves the right to update or modify its terms. Any changes will be immediately posted on the site, and users will be deemed to have accepted the terms on their first use of the site following the alterations.

The User is prohibited from uploading images:
of which the copyrights vest in any third parties;
which contain an image in violation of the law. The User is solely responsible for obtaining permission to use or rights for the photos they upload. The User grants OINIX a license to use materials (including those for which intellectual property rights apply) posted by them on the OINIX platform. The User grants the Administration the right to use their content and photos for OINIX purposes free of charge. The User confirms their consent to the processing of their personal data. Revocation or deletion of data after integration into the mosaic and publication is possible only in exceptional cases and is associated with compensation for costs incurred by OINIX.

§ CONTENT

All content (images, data, text, or other materials) submitted for the purposes of the OINIX project, hereinafter referred to as "Content," remains the property of the User.

§ RESPONSIBILITY FOR THE CONTENT

The User understands that they are solely responsible for the Content posted on or through the Service. The User represents that they have all necessary rights to the Content and are not infringing or violating any third party’s rights.

§ RIGHTS YOU GRANT OINIX

By approving the posting of their Content, the User grants OINIX a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of the Content to provide the Services and to promote OINIX.

§ COPYRIGHT RESPONSIBILITY

The User agrees and attests, by accepting this Agreement and using OINIX Services, that they own all rights (including copyrights) to the Content they post. If Content that the User owns and has rights to has been posted to the Services without permission and they want it removed, they can contact OINIX for further escalation and review. If the User's Content infringes another person’s intellectual property, OINIX will block it at their discretion.

§ PROPERTY OF OINIX

All compilations/mosaics generated and submitted for the project are the intellectual property of OINIX. Users are prohibited from copying, forwarding, distributing, reproducing, or publishing any information, texts, logos, brands, trade names, and such obtained through the OINIX website without prior approval from OINIX in writing or electronic form.

§ FINAL PROVISIONS

Any Agreements between OINIX and the Customer shall be governed by German law. Disputes in connection with Agreements shall be adjudicated by the German court having jurisdiction in the registered place of business of OINIX.

If one or more provisions of this Agreement are found to be invalid or unenforceable, it does not affect the remaining provisions.
